General terms and conditions

  • Offers and quotations
    Offers are non-binding as long as stocks last and can be revoked without regard to any formal conditions.
  • Delivery Times
    Exceeding the delivery time cannot be held against TreeQuattro and does not entitle the buyer to dissolve the agreement.
    Exceeding the delivery time can never result in a claim for compensation from the buyer.
  • Pricing
    All prices are ex nursery, excluding VAT, pallets and other government levies, unless otherwise agreed.
    Shipping or transport costs are to be borne by the buyer.
    Price increases resulting from additions and changes to the order are at all times at the expense of the buyer.
  • Payment
    Payment by the buyer must be made within 14 days of the invoice date, without deduction of any discount. Settlement is not permitted.
    All goods delivered remain the property of TreeQuattro until the invoices for these goods have been paid in full.
  • Complaints
    The buyer is obliged to thoroughly inspect the goods for any defects immediately after delivery, and in the event that any defects are discovered, to inform us immediately in writing.
    If the purchaser does not inform us in writing within eight days after the day of delivery about defects, which could have been discovered upon thorough inspection, the purchaser is deemed to agree with the state in which the goods were purchased, delivered or completed and all rights to complain lapse.
    The purchaser may no longer invoke a defect in the performance, which could not have been detected during an initial inspection (as previously mentioned), if he has not protested to us in writing about the defect within eight days after he has detected or should reasonably have detected it.
  • Liability of TreeQuattro
    TreeQuattro is never liable for any direct or indirect damage suffered by the buyer as a result of deficiencies in the delivered goods or caused by TreeQuattro, its employees or auxiliary persons, as far as this damage exceeds the agreed and invoiced purchase price, unless the damage is caused by intent or gross negligence of TreeQuattro or persons for whom it is responsible.
    If the goods are provided with a plant passport and/or a health certificate, issued by the Nederlandse Plantenziektekundige Dienst (Dutch Plant Protection Organisation), or any other officially authorised body, we are never liable to the buyer based on health regulations which apply in the country of transit or destination.
    Calls should be reported at least three working days before the delivery date.
  • Authenticity of species
    The seller guarantees the authenticity of variety of the goods supplied, not their regrowth.
    For mutants, this guarantee shall be limited to the limits of the main variety, due to the possibility of recombination.

 

  • Final stipulations

All our agreements are exclusively governed by Dutch law.

If a version of these general terms and conditions drawn up in a foreign language is provided for the benefit of a foreign buyer, the general terms and conditions originally drawn up in the Dutch language shall continue to apply in the event of differences of interpretation.
